In a 5-4 decision, the Supreme Court overturned the federal law that defines marriage as a heterosexual union, saying it violates the rights of married gay couples by denying them government benefits, Bloomberg reports. Justice Kennedy writes for the majority and states that the Defense of Marriage Act: …imposes a disability on the class by refusing to acknowledge a status the State finds to be dignified and proper. In a ripping dissent, Scalia says the majority has resorted to calling opponents of gay marriage “enemies of the human race.” The L.A. Times is reporting more than 100,000 gay and lesbian couples who are legally married will be able to take advantage of tax breaks, pension rights and other benefits that are available to other married couples.
