Forbes reports on two dueling decisions regarding whether ObamaCare’s health insurance subsidies are legal in state that have not created their own Exchange. A three-judge panel of the D.C. Circuit Court of Appeals ruled that the Obama administration did not have legal authority to offer subsidies to insurance purchasers in the 36 states that have not created their own Exchange – a ruling that, if it stands, will gut ObamaCare. Then, just a few hours later, the Fourth Circuit Court of Appeals ruled the opposite way on the same issue. The Obama administration has already indicated it will appeal the D.C. ruling.
